Appeal Bonds

Appeal bonds are also known as supersedeas bonds. This special type of surety bond is requested by the court when you want to delay payment. This delay is often requested to line up with sentencing or appeals. Because appeal bonds offer more flexibility, the requirements may be different.

Bail Agreements

This agreement is signed by the indemnitor to guarantee the defendant will comply with bail conditions or the bond agent has the right to take over the collateral pieces to make the bond payment. The agreement contains information such as the indemnitor's details, bail amount, case details, and more.

Bail Conditions

These conditions are restrictions on the defendant set by the court prior to granting bail. In addition to the compulsory condition of attending all proceedings, bail conditions may also restrict travel and continued employment, mandate regular check-ins with the bail agent, and more.

Bond Indemnitor

If you serve as a bond indemnitor, you will sign an agreement with the bail agent. In this role, you are responsible to ensure that the defendant follows all bail conditions. If the defendant fails to do so, the indemnitor will have to pay the full bail amount.

Collateral

In addition to the service fee, you might also be required to keep a valuable resale article, cash, or property as security. In the event of the defendant failing to comply with bail conditions, your agent can use this collateral to pay the full bail amount to the court.

Removing Bond Liabilities

Once all bail-related conditions have been satisfied and the court verifies the discharge of the bond, the bond liabilities are removed. At this time, the bail agent will also release any collateral you may have pledged if all pending service payments have been made.

Surety Bonds

This agreement is between the defendant or indemnitor, court, and bail agent. The defendant is released upon the surety that they will comply with bail conditions. If not, the bail agent pays the court. The indemnitor or defendant must then pay the agent.

Skipping Bail

A defendant skips bail when he or she leaves the jurisdiction and fails to appear before the court and attend court proceedings. The court, at this point, takes a call to cancel bail and issues a bench warrant for the defendant's arrest.

Withdrawal of Bail

A bail bond can be withdrawn or denied either by the court or the bail agent if certain bail conditions are not met or when the defendant's plan to flee comes to notice. A bail can also be withdrawn if the defendant commits a crime during the bail period.
